Supreme Court rejects bid to overturn Biden’s win in Pennsylvania.

The high court acted without comment or noted dissent in the matter.

The Supreme Court has rejected a bid by a Republican member of Congress and other GOP activists to overturn President-elect Joe Biden’s win in Pennsylvania.

In an order Tuesday afternoon, the justices turned down the emergency request from Rep. Mike Kelly (R-Pa.) and two other House candidates to decertify the results of last month’s election in the Keystone State.

The high court acted without comment or noted dissent in the matter on the last day under federal law for states to submit their slates of presidential electors without being subject to potential contest in Congress.

Kelly’s suit, which was rejected by Pennsylvania courts, argued that legislation the state adopted last year allowing for no-excuse, mail-in voting violated the state constitution and that the results of last month’s vote should therefore be invalidated.

Critics said the request for the Supreme Court to take up the case was ill-founded because the justices do not typically step in to enforce state law provisions. They also faulted Kelly for waiting more than a year — and until after the hard-fought election was complete — to raise the legal challenge.

“A contingent of Trump supporters tried to fan the flames around the case. Sen. Ted Cruz (R-Texas) sought to inject himself into Kelly’s case, going on a media campaign offering to present oral arguments, should the court have heard the case.

Roy Moore, who in 2017 lost a special Senate election in Alabama to Doug Jones, also
submitted a friend of the court brief that seemingly argued most early and mail voting should be deemed unconstitutional.

‘Safe harbor’ provision secures Joe Biden’s Electoral College win.

All US states except Wisconsin appear to have met a deadline
under federal law to resolve disputes arising from the November 3 presidential
election, thereby ensuring Joe Biden’s victory, the Associated Press reports.

Tuesday is the so-called safe harbor deadline for states to resolve
disputes arising from the election. Under US law, Congress will consider
a state’s election result to be “conclusive” if it is finalized by the safe harbor date.

Other than Wisconsin, every state appears to have met the deadline,
which essentially means Congress has to accept the electoral votes
that will be cast next week and sent to the Capitol for counting on January 6.

Those votes will officially elect Biden as the country’s next president.

“What federal law requires is that if a state has completed its
post-election certification by December 8, Congress is required
to accept those results,” said Rebecca Green,
an election law professor at William & Mary law school in Williamsburg, Virginia.

The Electoral College is a creation of the Constitution but Congress
sets the date for federal elections and, in the case of the presidency,
determines when presidential electors gather in state capitals to vote.

In 2020 that date will be December 14. But Congress also set another deadline,
six days before electors meet, to insulate state results
from being challenged in Congress.

By day’s end on December 14, every state is expected to have made
its election results official,
awarding 306 electoral votes to Biden and 232 to President Donald Trump.

Trump’s refusal to accept defeat;

The attention being paid to the normally obscure safe harbor provision
is a function of Trump’s unrelenting efforts to challenge the legitimacy
of the election. He has refused to concede,
made unsupported claims of fraud
and called on Republican lawmakers in key states to appoint electors who would vote for him even after those states have certified a Biden win.

Supreme Court ruling a crushing defeat for Trump
The Supreme Court's decision to deny a challenge to Pennsylvania's certification of the 2020 election ends President Donald Trump's campaign to overturn the election.

The Supreme Court's action is a crushing loss for Trump, who has frequently touted the high court's potential to overturn his election loss.

Just hours before the court's order was released, Trump made a direct appeal to state officials and members of the Supreme Court to assist him in his efforts to subvert the will of voters, as he continually and falsely suggested there was massive voter fraud during the election.

"Let's see whether or not somebody has the courage, whether it's legislators or legislatures or a justice of the Supreme Court or a number of justices of the Supreme Court," Trump said.
"Let's see if they have the courage to do what everybody in this country knows is right."

Tuesday's one-line order was issued with no noted dissents or comment from any of the nine justices. The court is made up of six conservative justices -- including Trump's three nominees -- Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett -- and three liberals.
The quick action with no dissents is a signal the Supreme Court may not want to get involved in the ongoing Trump challenges.

"The fact that the justices issued a one-sentence order with no separate opinions is a powerful sign that the court intends to stay out of election-related disputes, and that it's going to leave things to the electoral process going forward," Vladeck said.
"It's hard to imagine a more quietly resounding rejection of these challenges from this court," Vladeck added.

‘There could not be a more glaring smackdown’ of Trump than SCOTUS dismissal: Ex-US Attorney.

Former federal prosecutor Joyce Vance weighed in on the Supreme Court’s rejection of a last-ditch Republican lawsuit to challenge the results of the Pennsylvania election.

“You don’t have to be a good lawyer to understand this bevy of cases Trump and Trump supporters filed are not a close call, as you say, and the Supreme Court, with absolutely no dissent, makes abundantly clear tonight that this case has so little merit they are not even willing to entertain briefing or argument or any sort of further process on this case — that they have simply ended it out of hand and it is over,” said Vance.
“There could not be a more glaring smackdown of a case.”

Arizona’s Supreme Court;
unanimously rejected GOP case to change Trump’s loss.

President Donald Trump has now lost 51 lawsuits
attempting to overturn the results of the 2020 election.

Tuesday evening, Arizona’s state Supreme Court voted unanimously
to reject the Republican Party’s attempt to change the result.

The GOP lawyer “fails to present any evidence of misconduct, illegal votes
or that Biden Electors did not in fact receive the highest number of votes,
” Reuters reporter Brad Heath tweeted with a screen capture of the decision.

“The November 9, 2020 hand count audit revealed no discrepancies i
n the tabulation of votes and the statistically negligible error presented
in this case falls far short of warranting relief under A.R.S. § 16-672.”

Alan Dershowitz on Sunday said that the Supreme Court's decision to toss the Texas election lawsuit signaled a message to President Donald Trump's camp that they "can't count of the judiciary" to invalidate the election results, according to The Hill.

Dershowitz said that Trump's campaign needed a "perfect storm" in order to invalidate the election results, with courts, governors, and state election officials aiding his cause.

"I suspect on Monday we will see the electors…elect Joe Biden," he said. "Whether you like that or you don't like it, that's the reality that the Trump team has to face."

Constitutional law scholar Alan Dershowitz on Sunday said that the Supreme Court's decision to toss the Texas election lawsuit signaled a message to President Donald Trump and his allies that they "can't count of the judiciary" to invalidate the election results, according to The Hill.

Dershowitz spoke about the recent case that sought to overturn the results in Georgia, Michigan, Wisconsin, and Pennsylvania during a WABC 770 AM radio interview with New York businessman John Catsimatidis. In an unsigned order issued on Friday, the high court rejected the lawsuit due to lack of standing.

"The three justices that President Trump appointed, his three justices, voted not to hear the case," Dershowitz said. "I think it's a message to him and his team that you can't count on the judiciary, you can't count on the courts," he said.

During his presidency, Trump successfully installed jurists Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett to the Supreme Court, which shifted the balance of the court to a 6-3 conservative majority.

He said that Trump's campaign needed a "perfect storm" in order to invalidate the election results, with courts, governors, and state election officials aiding his cause.

However, with the Electoral College meeting on December 14, further attempts to litigate the results are even more implausible as they were after the election was called for President-elect Joe Biden in November.

Dershowitz said that state legislatures are "very, very unlikely" to help the president.

He added: "So I suspect on Monday we will see the electors…elect Joe Biden. Whether you like that or you don't like it, that's the reality that the Trump team has to face."

The Trump campaign has unleashed a litany of election lawsuits across the country since the election was called for Biden, with virtually all of the litigation proving unsuccessful. Nonetheless, the president continues to spread debunked allegations of widespread voter fraud, none of which have been successfully proven in court.

The Supreme Court ruling on Friday came just days after the court declined to take up a similar Republican-backed case that focused on Pennsylvania's election results.

Rudy Giuliani, Trump's personal attorney, told Newsmax on Friday that the campaign would present its case in district court.

"We're not finished," he said. "Believe me."

Dershowitz was a member of Trump's defense team during his impeachment trial earlier this year, where he argued that the president should not have been removed from office for abuse of power and obstruction of Congress because the charges did not constitute "high crimes."
