Merrick Garland called Donald Trump’s bluff.
Attorney General Merrick Garland held a press conference on Thursday revealing the Department of Justice has moved to unseal the Mar-a-Lago search warrant and redacted property receipt listing the items seized.
Following the press conference, former federal prosecutor Elie Honig offered his analysis during a CNN interview.
"We essentially saw Merrick Garland call Donald Trump's bluff," Honig said. "So essentially Merrick garland said, 'Okay, Donald Trump, you're not going to release them, we're going to do it, we're going to put those documents in front of the American public.'"
Honig also explained what he's looking for if the documents are unsealed.
"The warrant typically will list logistical information, place to be searched, usually a general description of items to be searched for, the name of the judge, a deadline by which DOJ has to execute the search," Honig said.
"But it also sometimes has what we call an attachment," he explained. "That attachment typically will list the statutes, the laws that DOJ believes it has probable cause to believe were violated. So that's going to be the first thing I look for. I'm going to look right at that attachment and say do they list the statutes, that's going to tell us what laws could be at play here."
The motion to unseal the documents asks the judge to unseal the search warrant "including Attachments A and B."

Former President Donald Trump attacked Barack Obama on Thursday after Attorney General Merrick Garland made a statement announcing that he plans to unseal the search warrant issued against Mar-a-Lago.
Garland said that normally the department wouldn't have said anything and simply spoken through their court filings but in this case he wanted to make it clear that they made every effort to obtain the documents requested and were - unable to obtain them from the former president.
Trump responded to the press briefing not by attacking Garland or proclaiming his innocence. Instead, Trump attacked Obama.
"I continue to ask, what happened to the 33 Million pages of documents taken to Chicago by President Obama?" Trump raged on his social media site.
"As was reported back in late 2016, the Obama team was transferring the records to Chicago through the National Archives, which legally owns the documents once a president leaves office." "Once the documents ultimately reached a warehouse in Chicago, the Obama Foundation was then due to pay the National Archives and Record Administration to digitize the documents. The lengthiness of that process aside, there isn’t the faintest hint of legal violations.

Trump has initial deadline of 3 pm tomorrow to decide whether to fight motion to unseal.
Federal Magistrate Judge William Matthewman has set an expedited schedule after Attorney General Merrick Garland announced the Department of Justice moved to unseal the Mar-a-Lago search warrant and property receipt.
Matthewman instructed DOJ to "immediately serve a copy of its Motion on counsel for former President Donald Trump."
"On or before 3.:00 p.m. Eastern time on August 12, 2022, the United States shall file a certificate of conferral advising whether President Trump opposes the Government's motion to unseal," the Judge explained.
However, if Trump moves to oppose the motion it could be weeks for the records are unveiled. In a separate docket entry suggests the motion phase of litigating the motion could last until Aug. 25.
Former DOJ Inspector General Michael Bromwich said today's press conference was a "shrewd and appropriate move."
"Puts Trump’s lawyers to the choice of opposing the motion to unseal or consenting to it. They lose either way," Bromwich concluded.

| Subject: Merrick Garland;Whether To Charge Donald Trump. Sun Aug 21, 2022 6:59 pm | |

Merrick Garland faces the major question of whether to charge Donald Trump.
Merrick Garland, the US attorney general, was denied a lifetime seat on the Supreme Court by Republicans in the Senate.
He now faces a decision arguably every bit as weighty as anything he may have faced on the nation's highest court: the potential prosecution of a former president of the United States.
The 69-year-old Garland personally approved the stunning August 8 FBI search of Donald Trump's Florida home and will have the final say on whether he is to be charged with any crimes.
Richard Nixon was pardoned by Gerald Ford before any criminal charges could be brought stemming from the Watergate scandal.
And while Nixon was a spent force anyway -- having resigned in disgrace -- the 76-year-old Trump retains an iron grip over the Republican Party and is openly mulling another run for the White House in 2024.
"The idea of prosecuting a former president for anything is pretty extraordinary," said Steven Schwinn, a law professor at the University of Illinois Chicago. "But Trump's actions were pretty extraordinary."
While the Mar-a-Lago raid appears to center around the mishandling of classified documents, Trump is also facing legal scrutiny for trying to overturn the results of the November 2020 election and for the January 6, 2021, attack on the US Capitol by his supporters.
Trump has not been charged so far in connection with either case but the House committee probing the Capitol riot, in a series of public hearings, has laid out a roadmap for Garland to potentially follow.
Whether he will do so is the burning question in the nation's capital.
Garland is politically astute enough to foresee the consequences of going after Trump, Schwinn said, and has "complicated considerations to put in the balance."
"On the one hand, Garland has got to be thinking about what his job is -- and that is enforcing the rule of law," he said.
"On the other hand, he is undoubtedly aware that any criminal pursuit of former President Trump is going to embolden his base and has already led to threats of violence against federal officers and others."
A graduate of Harvard Law School, the professorial and soft-spoken Garland is no stranger to high-profile investigations.
As a federal prosecutor, he notably led the probe into the 1995 Oklahoma City bombing by far-right extremists that left 168 people dead. He also prosecuted Ted Kaczynski, the "Unabomber." Garland went on to serve as chief judge on the US Court of Appeals for the District of Columbia
A stickler for protocol, Garland has tried to adhere to the Justice Department's policy of not commenting on ongoing investigations.
He said the decision to search Trump's home was not taken "lightly" and stressed that "the rule of law means applying the law evenly without fear or favor."
