Bannon is in 'a great deal of trouble' with NY prosecutors — and can't get out of it this time: former Trump lawyer.
On Wednesday's edition of CNN's "OutFront," former Donald Trump attorney Ty Cobb outlined how the new charges in New York against longtime Trump adviser Steve Bannon for the We Build The Wall scheme could be a legal dead end for him.
Bannon, who just received a federal conviction on two counts of contempt of Congress for refusing to cooperate with the House January 6 Committee, was previously pardoned by Trump for his role in the same scheme for which the state charges were filed.
"You worked at the White House at the same time as Steve Bannon," said anchor Erin Burnett. "The charges in this case are new charges, related to his fundraising scheme to build a border wall. He raised $25 million and took $1 million for his personal use, and that's fraud. How much trouble do you think he's facing?"
"I think he's in a great deal of trouble," said Cobb. "Two of the three colleagues with whom he was charged federally have pled guilty in that case and will be sentenced.
The third went to trial, they had a mistrial. He'll be tried again. But I wouldn't be surprised at all to see the colleagues who pled guilty show up on the witness list for the government, assuming the government even needs them."
The facts of the case, Cobb added, "seem straightforward."
"They raised $25 million, assuring people that it would all go to the wall-building project," said Cobb. "Bannon siphoned out $1 million, according to the allegations, and the allegations that the other individuals pled guilty to. I don't think that Bannon has much of a chance in that case. And it will likely result in his conviction and incarceration."
The new charges come as the IRS strips tax-exempt status from a dark money group run by Bannon, which allegedly received some of the money diverted out of We Build The Wall.

| Steve is in big big trouble-
(1) trump pardoned him Before he was prosecuted by Federal-Now that case is being prosecuted by the State-
(2) Steve can not stop it by claiming double jeopardy-It was never prosecuted when trump pardoned him-
(3) the four others involve all pleaded guilty and only Steve was pardoned, so the state has all their confessions involving Steve.
(4) there is no defense that can save him a slam dunk.

The former White House adviser faces state charges in a charity fraud case after a Trump pardon let him evade federal counts..
NEW YORK — Longtime Trump ally and right-wing firebrand Stephen Bannon, who dodged federal charges in a charity fraud case thanks to a last-minute presidential pardon, must now face the music in New York state court.
Bannon, 68, arrived in handcuffs to a crowded arraignment in Manhattan’s New York County Supreme Court Thursday afternoon, hours after surrendering to Manhattan District Attorney Alvin Bragg. Moments before the controversial former White House adviser entered, Bannon remarked, “They will never shut me up, they’ll have to kill me first.” But inside, he said little, other than acknowledging a judge’s instructions — a heavy contrast to the bombastic and inflammatory persona that has become his trademark.
'A Six-Count Indictment' charges Bannon with __money laundering, conspiracy and scheming to defraud for his alleged role in We Build the Wall, a group that raised at least $15 million to construct a barrier along the border with Mexico but skimmd the donations.
The group publicly told donors its president and CEO, Air Force veteran Brian Kolfage, would not be compensated for his efforts. But Bannon allegedly arranged to pay him by moving money from We Build The Wall through a company he controlled. Kolfage previously pleaded guilty in the federal case. Only Bannon and the company were charged by the state.
Bannon pleaded not guilty Thursday. If convicted on the top charge, he faces a maximum 5 to 15 years in prison, according to Bragg.
“The simple truth is that it is a crime to profit off the backs of donors by making false pretenses,” Bragg said at the press conference. “We are here to say today in one voice that in Manhattan and in New York you will be held accountable for the defrauding of donors.
Acting Supreme Court Justice Juan Merchan ordered Bannon to surrender his passports. Prosecutors argued he has the means and the disposition to flee, citing his recent, unrelated contempt of Congress conviction for defying a subpoena related to the Jan. 6 attack on the Capitol.
The judge also warned Bannon that if he is willfully absent during court proceedings, they could move forward without him.
In 2020, federal prosecutors accused Bannon of pocketing some $1 million in donations, using them to pay off hundreds of thousands of dollars of his own personal expenses.
That year, federal agents arrested Bannon on the charges while he was aboard a luxury yacht off the coast of Connecticut. He pleaded not guilty, but was dropped from the case after Trump issued the pardon in the twilight hours of his presidency.
Presidential pardons apply only to federal charges and cannot shield Bannon from a state prosecution. Former Manhattan DA Cyrus Vance opened a state investigation that his successor.
At a press conference announcing the charges, New York Attorney General Tish James said Bannon’s presidential pardon unfairly leveraged his political connections.
Kolfage and another federal co-defendant pleaded guilty to wire fraud conspiracy.
Federal prosecutors previously said the group raised over $25 million, but the state’s indictment Thursday only referred to about $15 million.
Bragg chalked the discrepancies up to the differences between state and federal jurisdiction, as well as the laws Bannon was being charged under State investigators only looked at money raised through GoFundMe, where they could be certain donors saw a disclaimer that no proceeds would go to Kolfage.
As Bannon arrived at the DA’s office Thursday morning, some onlookers lobbed insults at the far-right iconoclast, who has stoked controversy at frequent turns. In the past, Bannon has suggested Anthony Fauci, the nation’s leading infectious disease expert, should be executed. He has also echoed Trump’s false claims that the 2020 election was stolen.
“Stop hurting America, you greasy grifter,” one woman yelled as Bannon entered the building, his brief remarks drowned out by the heckling.

Former adviser to former US president Donald Trump Steve Bannon claimed that the FBI executed raids targeting dozens of Donald Trump supporters this week.
On the conservative Charlie Kirk Show on Friday, Bannon said: “there were 35 FBI raids yesterday” targeting “senior members of MAGA, Republican supporters of Donald Trump.” He commented that there was no need for the raids, as “these people have lawyers,” adding that the “jack-booted Gestapo” intentionally made a “big display of this.” - referring to US President Joe Biden.
According to Bannon, the Washington establishment is adamant about silencing any opposing voices and is resorting to “lawfare, financial terrorism, law—you know, everything legally — and quite frankly, up to assassinations.”
The prominent conservative figure expressed that “this is all about intimidation,” with the Biden administration acknowledging that “they are losing, after vowing not to give in, saying: “Screw them. I spit right in their eye, I can’t care less.”
Bannon's claims come just one day after he was indicted at a court in Manhattan on multiple charges, specifically conspiracy and money laundering, linked to a crowdfunding fraud scheme by allegedly swindling donors out of money meant to fund a wall on the border with Mexico. After being arrested on Thursday morning, Bannon pleaded not guilty to all counts and was reportedly released without bail later in the day.
The controversial figure was found guilty of contempt of Congress in July after a brief trial that featured only two government witnesses who detailed the longtime Donald Trump aide's defiance of a House committee's demand for records and testimony in its investigation of the Capitol attack.
Upon being asked by the host of the show to confirm the truth of the 35 FBI raids, adding that this has not this reported in any media outlet, the former Trump adviser replied: “I’m breaking that news right here.”
Newsweek magazine stated that it has reached out to the FBI to comment on Bannon’s allegations, but has received no response. |

Subpoenas were issued by Jan 6 committee One would think Bannon would know the difference between a subpoena and a search warrant. (which of course he does, but claiming ‘raids’ is far more inflammatory!
The Justice Department is seeking details about the formation and operation of Donald Trump’s post-presidential political operation, according to three people familiar with the probe, sending a raft of subpoenas in a significant expansion of the criminal investigation of the Jan. 6, 2021, attack on the Capitol and efforts to overturn the results of the 2020 election.
A federal grand jury sent subpoenas on Wednesday to a wide range of former campaign and White House staffers asking for information about the Save America PAC, according to the people, who spoke on the condition of anonymity to discuss an ongoing probe. They described the subpoenas as broad, seeking all documents and communications about opening the PAC and every dollar raised and spent.
At least one of the subpoenas also demanded information about the plan to submit slates of phony electors claiming Trump won pivotal states, including all communications with several key lawyers and advisers involved in the effort, one of the people said. They include Rudy Giuliani, Boris Epshteyn, Bruce Marks, Victoria Toensing and Joseph DiGenova, this person said.
Another one of the three people, who has direct knowledge of one of the subpoenas, said the document was “wide ranging” and included multiple other categories of information, but this person declined to describe them. FBI agents served at least some of the subpoenas in person on Wednesday, one of the people with knowledge said.

The House referred Steve Bannon for prosecution last year after he defied the January 6 committee.
Bannon argued ahead of sentencing that any jail term should be "suspended" pending his appeal.
The Justice Department had recommended a six-month sentence and a $200,000 fine for Bannon.
A federal judge on Friday sentenced Steve Bannon to four months in prison but allowed the Trump ally to remain free while he appeals his criminal conviction on charges he defied the House committee investigating the January 6, 2021, attack on the Capitol.
Judge Carl Nichols, a Trump appointee, handed down the sentence during a hearing in a Washington, DC, federal court, where a jury found Bannon guilty in July on a pair of contempt of Congress charges.
Ahead of Friday's sentencing, federal prosecutors recommended that Nichols sentence Bannon to six months in prison, and order him to pay a $200,000 fine. In a court filing, the prosecutors said Bannon "flouted the Committee's authority and ignored the subpoena's demands."
Bannon's defense lawyers argued that the former Trump advisor should avoid prison time and receive a probation-only sentence. But they urged Nichols to suspend — or put on hold — any sentence while Bannon brings a challenge to his criminal conviction.
Bannon had declined to testify in his own defense or call any witnesses during his trial. But after each day of the proceeding, he emerged from federal court to rail against the Justice Department and the House January 6 committee.
The jury found Bannon guilty after only a few hours of deliberations. That day, Bannon declared that he had lost the "battle" but not the "war," signaling that he would challenge his conviction before the US Court of Appeals for the DC Circuit.
In the months leading to the trial, Nichols made a series of rulings that severely limited Bannon's potential arguments. For instance, Nichols barred Bannon's defense team from arguing that executive privilege excused his refusal to sit for questioning or turn over records subpoenaed by the House January 6 committee.
Citing decades-old DC Circuit precedent, Nichols also prevented Bannon from arguing that he was following the advice of his lawyer in declining to comply with the House January 6 panel's subpoena. But Nichols appeared to make the ruling reluctantly, emphasizing that he was bound by a 1961 appeals court ruling that took the so-called "advice of counsel" defense off the table in contempt of Congress cases.
After months of refusing the House panel's demands, Bannon attempted an about-face on the eve of trial and told the committee that Trump had waived executive privilege and freed him to cooperate with the panel's investigation.
Prosecutors cited the last-ditch offer in their sentencing recommendation this week, saying it "proved a hollow gesture."
"When he realized that his eleventh-hour stunt would not prevent his trial, the Defendant's cooperative spirit vanished," prosecutors said. "Despite the removal of the only purported barrier to his compliance, to this day the Defendant has not produced a single document to the Committee or appeared for testimony."
In their court filings, prosecutors revealed new details about the Bannon legal team's dealings with the House committee ahead of his trial.
Just days before the trial was set to begin, Bannon's defense lawyer Evan Corcoran, contacted the House January 6 committee to push the congressional panel to recommend that the Justice Department drop charges in exchange for Bannon's cooperation. The House committee's top investigator, Timothy Heaphy, took contemporaneous notes of the call and had a staff member join as a potential witness.
Later, while being interviewed by an FBI agent, Heaphy "described the overall 'vibe' of his conversation with Corcoran as defense counsel's attempt to solicit the Select Committee's assistance in their effort to delay Bannon's criminal trial and obtain a dismissal of the contempt of Congress charges pending against him," according to a summary of the October 7 interview.

Steve Bannon calls for 'war' and 'ultimate conclusion' in speech to 'army' of young conservatives.
Right-wing podcaster Steve Bannon told a crowd of young conservatives that they were an "awakened army" at "war" with the deep state.
Bannon began his Tuesday speech at Turning Point's America Fest event with a battle cry.
"Are we at war?" he shouted.
"Yeah!" the crowd answered.
"Are you prepared to take this to its ultimate conclusion and destroy the deep state?" Bannon asked.
"Yeah!" the audience exclaimed.
"This is what they fear," Bannon said. "They fear not just an electorate that is informed, but an electorate that says, 'No longer are we just going to sit there and take it!'"
"You are an awakened army!" he bellowed to cheers.
Bannon acknowledged that he would be criticized for getting the crowd "all worked up." But he also didn't condemn violent actions.
"Trump won! You're damn right he won and Trump won big," the former White House adviser insisted. "If we're prepared to accept [Trump's loss], you're prepared to be a subject; you're prepared to comply. You're prepared to get on your knees to the administrative state."
Bannon held the microphone up so the crowd could chant, "We will not comply!"
The conservative podcaster is facing four months in prison after being found guilty on two counts of contempt of Congress for refusing to cooperate with the Jan. 6 Committee. Bannon has been accused of plotting a coup to overturn the 2020 presidential election.
