Four former Presidents of the D.C. Bar Association - have signed a letter calling on the group to investigate whether Attorney General William Barr has violated its rules.
The District of Columbia Bar authorizes lawyers to practice in the city and has the power to punish them for breaking its rules and to revoke their law licenses.
The complaint argues that Barr has broken Washington's ethics rules by being dishonest and violating his oath to uphold the Constitution, along with other charges. And it highlights four episodes in Barr’s time as attorney general to make the case: his characterization of special counsel Robert Mueller’s report on Russia’s 2016 election interference, his criticism of an inspector general report on the Russia probe, his criticism of FBI officials in a TV interview, and his role in the disbursement of peaceful protesters from Lafayette Square, outside the White House. A spokesperson for the Justice Department declined to comment.
“Mr. Barr’s client is the United States, and not the president,” the letter says. “Yet, Mr. Barr has consistently made decisions and taken action to serve the personal and political self-interests of President Donald Trump, rather than the interest of the United States.”
Barr’s early description of the Mueller report and his handling of protesters in Lafayette Square have long drawn pointed criticism. But his comments on the inspector general report on the FBI’s Russia probe hasn’t drawn as much attention. In an NBC News interview after the report’s release, Barr called the FBI’s basis for opening the Russia probe “very flimsy.” The letter argues that the criticism was dishonest.
“Indeed, the notion that the legitimacy of an FBI investigation’s initiation should be judged by its end, if applied broadly, could easily chill the initiation of wholly legitimate inquiries for fear of being second-guessed,” the letter adds.
The letter also argues that Barr broke the D.C. Bar’s rules when he criticized former FBI officials’ decisions regarding the Russia probe and suggested they could be prosecuted.
The letter focused on a comment Barr made in a CBS News interview: “Just because something may even stink to high heaven and ... appear [to] everyone to be bad, we still have to apply the right standard and be convinced that there’s a violation of a criminal statute.” BBC The letter argued the statement could unfairly influence potential criminal proceedings against those officials and that Barr should have followed the standard DOJ practice of declining to comment on ongoing investigations.
John Durham, the U.S. attorney for Connecticut, is investigating the Russia probe’s origins. Some Trump allies, including White House chief of staff Mark Meadows, have intimated that he will bring criminal charges against officials who worked on the probe.
Justice Department spokesperson Kerri Kupec recently told Fox News that Durham is expected to issue a report by summer’s end. “There are no guarantees in life, but we certainly hope to see one by the end of the summer. I think it’s important,” she said.
The complaint’s signatories include a host of legal ethics experts and former government lawyers. Andrea Ferster, Philip Allen Lacovara, Marna S. Tucker, and Melvin White — all former presidents of the D.C. Bar — also signed on.
The letter comes as Barr faces sharp criticism from leaders in the legal profession.
Late last month, the president of the New York City Bar Association and chair of its task force on the rule of law sent a letter to top members of Congress calling him “unfit” for his job and raising some of the same concerns raised in this letter. Show less

Federal judge rules Bill Barr improperly redacted part of the Mueller report — and must release them.
Although the U.S. Department of Justice under Attorney General William Barr publicly released the Mueller report on April 18, 2019, it has only been available to the public in redacted form.
But on Wednesday, Judge Reggie Walton ruled that parts of the Mueller report were improperly redacted by Barr — and Walton has ordered the DOJ to release those parts of the report before Election Day.
Barr’s response to Mueller report, which Robert Mueller gave to Barr in March 2019 after completing his extensive Russia investigation. Earlier this year, in March 2020, Barr “failed to provide a thorough representation of the findings” of the Mueller report and wondered if Barr had made a “calculated attempt to influence public discourse” about Mueller’s investigation in favor of Trump.

On Thursday, 1,600 former officials from the Department of Justice signed a scathing open letter warning that Attorney General William Barr poses a threat to democracy.
“We fear that Attorney General Barr intends to use the DOJ’s vast law enforcement powers to undermine our most fundamental democratic value: free and fair elections,” said the letter. “He has signalled this intention in myriad ways, from making false statements about the security of mail-in voting from foreign hackers to falsely suggesting that mail-in ballots are subject to widespread fraud and coercion.
Most recently, the Department made a premature and improper announcement of a mail-in ballot tampering investigation that the White House immediately used as a talking point in its campaign to discredit mail-in voting and to further the claim it will be rigged against President Trump.”
In particular, the letter highlights the Durham investigation, which with Barr’s blessing is investigating the origins of the Russia probe and has raised suspicion that Barr is attempting to politically undermine the legitimacy of prosecutions of former Trump associates.
“The Inspector General should protect the DOJ’s integrity by answering the call of the House of Representatives to open his own investigation into election interference,” concluded the letter. “And given Attorney General Barr’s demonstrated willingness to use the Department to help President Trump politically, the media and the public should view any election-related activity by the DOJ — including any announcement or findings related to the Durham investigation — with appropriate skepticism.”

WATCH: Bill Barr prays with radical right-wing activist who wonders if vaccines make kids gay.
Attorney General Bill Barr has been conspicuously missing from public view over the past few months but over the weekend he came outside of his home to meet with a far right wing religious extremist, and to pray with him.
“On Friday and Saturday, a small group of right-wing activists,” Right Wing Watch reports, “led by radical religious-right bigot Dave Daubenmire, carried out a series of protests outside the home of Joe Biden in Delaware, as well as the home of former president Barack Obama in Washington, D.C., demanding that the Democratic presidential nominee and the president for whom he worked as vice president be arrested, tried, and executed for treason.”
On Saturday afternoon, Daubenmire and crew took their protest to the home of Attorney General Bill Barr- who personally came out to meet the group, pray with them, and take photos with them.
Barr is an uber-conservative Catholic who supports dominionism. Last year Joan Walsh at The Nation called him “a paranoid right-wing Catholic ideologue who won’t respect the separation of church and state.”
Daubenmire, who is also a Christian minister, last month called for Hillary Clinton to be publicly executed.
Here’s video (below) of the meeting, which shows Daubenmire and other activists with Attorney General Barr, praying.
Some of the men wore shirts emblazoned with political statements, including “Crooked Hillary for Prison,” and “Lock’er Up.” Several were using Trump 2020 banners as blankets. One had a tee-shirt with “InfoWars,” a far right wing conspiracy website printed on the back.

Attorney General Bill Barr on Monday announced that the Department of Justice would investigate Donald Trump’s unfounded accusations of massive voter fraud in the 2020 election.
Neither Trump nor his campaign have shown any evidence of fraud that could alter the outcome of the election, which was won by Joe Biden and Kamala Harris.
But the Barr memo caused Richard Pilger to resign from running the DOJ department in charge of investigating election fraud.
“Yes, the Barr keeps getting lower,” Preet Bharara, the former U.S. Attorney for the Southern District of New York, tweeted.
“Who will be the first Senator to call for an Inspector General investigation over the AG Barr memo that just prompted the head of the Election Crimes Branch at DOJ to step down?” Bharara asked.
“For those keeping score, we’ve now seen 7 veteran career prosecutors resign from 4 different high-profile cases (Stone, Flynn, Durham, now this) to protest Barr’s political weaponization of DOJ,” CNN analyst and former prosecutor Elie Honig noted.
Vanita Gupta, who led DOJ’s Civil Rights Division, had harsh words.
“Pilger is staying at DOJ but his resignation from election crimes and the memo are a testament to how grossly politicized and partisan the Barr DOJ is, in service of Trump,” Gupta wrote. “It is a total travesty.”
Noah Bookbinder, the executive director of the watchdog group “Citizens for Responsibility and Ethics in Washingon” worried what would happen next.
“Richard Pilger is a respected apolitical attorney who has been a federal corruption prosecutor for decades. His resigning in protest makes clear to me that something very wrong indeed is happening here,” he warned.
Matthew Miller, who was the DOJ spokesperson during the Obama administration, was also worried about what happens next.
“I don’t think Barr can do anything to change the outcome of the election, but I’m surprised by how many people think this memo was just to satisfy Trump. Hope I’m wrong, but I assume there is some flashy investigation coming as well,” he warned.

Federal officials enraged as Bill Barr drops charges against Mexican general accused of cartel links.
On Wednesday, The Daily Beast reported that officials with the Drug Enforcement Agency are outraged after Attorney General William Barr convinced a federal judge to dismiss the case against Salvador Cienfuegos Zepeda, a Mexican general accused of helping cartels traffic drugs into the United States.
“Cienfuegos, who served as Mexico’s Secretary of National Defense from 2012 to 2018, was arrested last month on drug trafficking and money laundering conspiracy charges upon flying into Los Angeles International Airport,” reported David Shortell.
“In court documents, prosecutors alleged that Cienfuegos had been protecting and promoting the work of the violent H-2 cartel in exchange for bribes, citing thousands of intercepted Blackberry messages, including ones exchanged between Cienfuegos and a senior leader of the group.”
“On Tuesday night, Barr released a lengthy statement co-signed by his Mexican counterpart announcing the decision to seek the dismissal of the case and to return Cienfuegos to Mexico ‘so that he may be investigated and, if appropriate, charged, under Mexican law,” said the report.
“The top prosecutor in the Eastern District of New York told the court Wednesday that the decision to abandon the prosecution was made by Barr personally.”
Historically, Mexican prosecutors have frequently refused to pursue links between their government officials and organized crime, making it highly unlikely Cienfuegos will be charged by investigators in his own country.
“The move was met with deep frustration by some investigators involved in the case, two law enforcement officials with knowledge of the matter told The Daily Beast,” said the report.
“One of the officials said that certain senior leaders of the U.S. Drug Enforcement Administration, which helped build the investigation into Cienfuegos, had not been consulted ahead of the decision, and warned that the fallout could erode future investigations into the cartels and their ties to corrupt Mexican officials.”

Bill Barr sued by watchdog for records in potential DOJ corruption scheme.
On Thursday, the watchdog group Citizens for Responsibility and Ethics in Washington (CREW) announced a lawsuit against former Attorney General William Barr to obtain the records of a meeting he took with infamous Blackwater founder Erik Prince.
"CREW is suing the DOJ for records on any meetings that Barr and Prince had since they could reveal potential preferential treatment for Trump's allies in Department of Justice investigations," said the group their press release.
"Prince reportedly faced a DOJ investigation for apparently lying before Congress about the Russia probe following Representative Adam Schiff's request for a criminal investigation, but almost two years later, no investigation has been reported and no charges have been announced.
In addition to charges related to making false statements to Congress, DOJ apparently was considering whether Prince violated U.S. export laws, but no charges have been announced in that case either."
"Throughout his tenure, Barr consistently intervened in cases to the benefit of Trump's allies, including several Trump would later go on to pardon," continued the statement.
"In his final days as president, Trump issued pardon after pardon to benefit himself and his cronies, including for four Blackwater guards convicted of killing of Iraqi civilians.
Trump also pardoned Roger Stone and Michael Flynn, whose cases Barr and top DOJ officials had reportedly previously intervened in to withdraw stiff sentencing recommendations — in Stone's case, after Trump tweeted that the recommendations were unfair."
Prince, who is also a GOP megadonor and the brother of former Education Secretary Betsy DeVos, was reportedly also involved in a meeting in the Seychelles to try to establish a backchannel to the Kremlin for the Trump administration. He is currently facing United Nations sanctions for allegedly violating an arms embargo in Libya.

Legal experts sounded the alarm after a bombshell court filing was unsealed showing the Department of Justice under Bill Barr attempted to use a secret grand jury subpoena to learn the identity of a parody account on Twitter that is critical of Rep. Devin Nunes (R-CA).
"The Justice Department under President Trump secretly obtained a grand-jury subpoena last year in an attempt to identify the person behind a Twitter account dedicated to mocking Representative Devin Nunes of California, according to a newly unsealed court document.
But Twitter fought the subpoena, as well as an associated gag order barring the company from talking about it publicly. Twitter executives raised skepticism about whether the Justice Department might be abusing federal criminal law-enforcement power to retaliate against a critic of Mr. Nunes, a Republican who is a close ally of Mr. Trump, in violation of the First Amendment," The New York Times reported Monday.
The subpoena was withdrawn after Biden took office, but the new documents show Twitter blasting the subpoena.
"It appears to Twitter that the Subpoena may be related to Congressman Devin Nunes's repeated efforts to unmask individuals behind parody accounts critical of him. His efforts to suppress critical speech are as well-publicized as they are unsuccessful," Twitter wrote in a motion opposing the unmasking of the author.
"Given Congressman Nunes's numerous attempts to unmask his anonymous critics on Twitter—described in detail herein—Twitter is concerned that this Subpoena is but another mechanism to attack its users' First Amendment rights."
"Over the past two years, Congressman Nunes and his campaign committee have brought at least nine lawsuits— including in this district—against individuals, the media, and one research and intelligence firm for either their disagreement with his political actions and policies, publishing statements that Congressmen Nunes deemed critical of himself, or hosting critical statements with which Congressman Nunes disagreed," the social media company argued.
Legal experts blasted Barr's DOJ for the subpoena. Former Southern District of New York Assistant U.S. Attorney Richard Signorelli called for an investigation of the Assistant U.S. Attorney (AUSA) who signed subpoena.

Michael Friedman may not be the only attorney facing investigations over the subpoena.
Former federal prosecutor Daniel Goldman, who served as the majority counsel in Donald Trump's first impeachment trial, said Barr should lose his license to practice law.

Documents about fake Bill Barr investigation of Trump obstruction of justice must legally be released Monday. (((today)))
The deadline to release the Justice Department documents federal Judge Amy Berman Jackson ruled must be revealed is Monday, May 24.
Judge Berman Jackson's 35-page opinion in Citizens for Responsibility and Ethics in Washington v. U.S. Department of Justice confirmed that former Attorney General Bill Barr lied to Congress when he said that he worked with other DOJ lawyers to decide whether or not to indict then-President Donald Trump.
She didn't release the document in early May because she gave the DOJ time to appeal her ruling if they wanted. Thus far, the DOJ hasn't appealed, meaning they'd have to file it Monday morning or the information will be released. Not only did Barr lie about the decision, he also created a fake paper trail to act as if there was a broader conversation with DOJ lawyers.
"Merrick Garland is the attorney general now, all new leadership at the Justice Department, all new priorities, moving forward with a million things at once, and here's a judge saying, you know, your immediate predecessor in this job lied to me, lied to the court and lied to the American public about something as freaking serious as why the former president was not charged with crimes."
"You cool with the evidence of all of that being released to the public? Because it's coming out in two weeks unless you want to appeal my ruling."
The question has become, if there was no actual conversation or Justice Department investigation into whether Trump should be held accountable for the obstructions of justice cited by special counsel Robert Mueller.
The difference between now and then is that before Trump was president and protected by the Office of Legal Counsel decision that dictated a president couldn't be indicted. Trump doesn't enjoy that protection now.
There's also a question of whether or not Barr should garner a criminal investigation for lying to the court, Congress and the American people and falsifying documents to justify his behavior.
