| The race between President Trump and Joe Biden remains too close to call despite Trump's false declaration early Wednesday that he has won, as vote counting continues in enough key battleground states that a final result could be delayed for days.
The latest: Trump declared that he'll go to the Supreme Court to push for "all voting to stop," baselessly calling the continued vote count a "fraud" as key states sort through a historically high volume of early and mail ballots driven by the coronavirus pandemic.

Former Vice President Joe Biden won Michigan and Wisconsin on Wednesday as his White House race with Donald Trump stretched into overtime, and the president’s team promised legal challenges.
A day after all polls closed, the presidency and control of the Senate were still hanging in the balance — though Biden had amassed a lead over Trump in Electoral College delegates, 264-214. It takes 270 to win.
In the Senate, Democrats’ path to retaking the majority narrowed when Republican Sen. Susan Collins hung on to her seat after a challenge from state lawmaker Sara Gideon, who’d led Collins in the polls for months.
U.S. stocks rocketed higher on Wednesday as Wall Street watched the results, with the Dow Jones Industrial Average DJIA, +1.33% having a historically strong post–Election Day outing.
Trump, meanwhile, was preparing challenges. His campaign filed a lawsuit in Michigan state court demanding access to locations where ballots are being counted. The campaign wants to review ballots that have already been opened and processed, the Associated Press reported. Suits were also filed in Georgia and Pennsylvania.

The campaign also said it would ask for a recount in Wisconsin. Trump campaign manager Bill Stepien cited “irregularities in several Wisconsin counties.”
Republicans’ likely retention of the Senate majority means “gridlock with the liberal House,” wrote Greg Valliere of AGF Investments in a note. “As a result, market-unfriendly tax hikes could stall in 2021,” said Valliere, the firm’s chief U.S. policy strategist. |

| According to data released on Wednesday, the United States Postal Service failed to deliver thousands of absentee ballots around the country before the cut-off times — and one of the worst failures occurred in South Florida, where 27 percent of mail-in votes may have never been received.
But those statistics might not be telling the entire story. Vice News reported Tuesday that ballots were not being scanned for delivery in an effort to speed up the process.
“What this means is the stats might look worse than they actually are, because in some cases postal workers have, for example, been manually postmarking the ballots and then passing them off for local same-or-next-day delivery, resulting in the ballots never being scanned into the system in the first place,” explained Vice reporter Aaron Gordon.
“Other measures, like sending ballots to the sorting facility but then removing them from the mail stream after they’ve been scanned and postmarked, means they are manually bypassing the rest of the process for expedited delivery and are thus scanned in and never scanned out.”

GOP Governor Calls Trump’s Premature Victory Remarks ‘A Terrible Mistake’
Maryland’s Republican Gov. Larry Hogan said the president’s false declaration that he’d won was “outrageous and uncalled for.”
Maryland’s Republican Gov. Larry Hogan slammed President Donald Trump on Wednesday for prematurely and falsely declaring victory in the election while also signaling that he would contest contrary results, saying that it was stirring up anger, frustration and division.
“I thought it was outrageous and uncalled for and a terrible mistake,” Hogan said during a Washington Post Live interview.
“I have often said, while we may have disagreements here and there, I said sometimes the president can be his own worst enemy. I think that was another example of it early this morning with the lashing out,” the governor added.
In the early hours of Wednesday morning, Trump declared himself the winner of the election even though millions of ballots still hadn’t been counted. He claimed any other result would be a “fraud on the American public” and accused Democrats of trying to steal the election.
He disparaged mail-in ballots counted after Election Day ― which are expected to favor his opponent, Joe Biden ― as fraudulent, even though counting votes after Election Day is a normal part of the process. Trump has since launched legal challenges in a number of battleground states to stop the counting of legitimately cast votes.
“Regardless of where you stand on this race and what party you are and who you voted for, most Americans really want a free and fair election process, and they want us to count the votes,” Hogan said.
“I think they are doing that in every state, and they’re being very cautious to make sure we count all the absentee ballots and provisional ballots. There’s Republicans and Democrats overseeing the process.”
“And to stir up all this anger and frustration, I mean, I think is a really bad mistake for the president to make and, quite frankly, I think that’s what voters rejected in this race, was the divisiveness and the kind of anger on both sides,” he added.
While Democrats have slammed Trump’s attacks on the electoral process as dictatorial and irresponsible, other Republican officials have been more muted about and even defended the president’s remarks. Asked about his colleagues’ silence, Hogan said it was driven by the same reason they’ve been “afraid to criticize the president for nearly four years now.”
“He can lash out and cause some real retribution against fellow Republicans,” Hogan said.
The governor added that perhaps he’s not as afraid of speaking up because he significantly outperforms Trump’s support in Maryland. Hogan’s state voted overwhelmingly in favor of Biden this year.

| U.S. Postal Service says 1,700 ballots found in Pennsylvania facilities David Shepardson, Reuters • November 5, 2020
WASHINGTON (Reuters) - The U.S. Postal Service (USPS) said about 1,700 ballots had been identified in Pennsylvania at processing facilities during two sweeps Thursday and were being delivered to election officials.
In a court filing early Friday, USPS said 1,076 ballots, had been found at the USPS Philadelphia Processing and Distribution Center. About 300 were found at the Pittsburgh processing center, 266 at a Lehigh Valley facility and others found at other Pennsylvania processing centers.
Ballots must be received by Friday evening in Pennsylvania in order to be counted. The vote for the U.S. president remains extremely close and Pennsylvania is one of the states that remains undecided.
About 500 ballots were also discovered in North Carolina during sweeps, USPS said on Friday.
U.S. District Judge Emmet Sullivan on Thursday had ordered twice daily sweeps at USPS facilities serving states with extended ballot receipt deadlines as votes were still being counted in U.S. election battleground states.
Some states, including Nevada and North Carolina, are counting ballots that are received after Election Day as long as they were postmarked by Tuesday.
Lawyers said at a court hearing on Thursday that USPS had delivered about 150,000 ballots on Wednesday.
"The vast majority were destined for postmark states and would be delivered on-time under state election law," USPS said.
Sullivan said the processing centers must perform morning sweeps and then afternoon sweeps "to ensure that any identified local ballots can be delivered that day."
Sullivan issued a separate order requiring USPS to "coordinate with all local county Boards of Elections in North Carolina or Pennsylvania" in order to deliver all ballots "before 5:00 PM local time in North Carolina or Pennsylvania" on Friday.
Ballots were still being counted by election officials in battleground states after polls closed Tuesday in one of the most unusual elections in U.S. history because of the novel coronavirus pandemic.

With the presidential election still undecided and former Vice President Joe Biden inching closer to victory, the Trump campaign has already moved to challenge the voting count in the states of Michigan, Pennsylvania and Georgia, setting the stage for the election to be decided in the courts.
“It is a very likely possibility,” that President Trump could win the election in the court, Rutgers Law Professor Stacy Hawkins told Yahoo Finance Live on Wednesday. “We have lots of indicators of what the justices might do — particularly if the challenge is around Pennsylvania, and the challenged ballots that might come in the day after the election and Friday.”
“Three justices, Justices Alito, Thomas, and Gorsuch, have already expressed a willingness to disallow the counting of those ballots. It is expected that Amy Coney Barrett might join them in that,” Hawkins explained. “You have what you need for the makings of the Supreme Court deciding the outcome of the election.”
The campaign has filed lawsuits in Michigan, Georgia, and Pennsylvania. Michigan’s race has been called for Biden with less than 1% of the lead, while Georgia and Pennsylvania remain undecided.
In a statement, Trump campaign manager Bill Stepien said “President Trump’s campaign has not been provided with meaningful access to numerous counting locations to observe the opening of ballots and the counting process, as guaranteed by Michigan law. We have filed suit today in the Michigan Court of Claims to halt counting until meaningful access has been granted.”
The campaign is also demanding the right to “review” all opened ballots from polling places where they weren’t granted access.
With the presidential race so close, the Trump campaign is entitled to challenge the results in some states.
Trump’s campaign has already demanded a recount in the state of Wisconsin, which went to Biden with less than a 1% lead, according to the Associated Press.
“And it seems as though in all of these key battleground states, as it was last year, these margins are razor thin,” said Hawkins, adding that Wisconsin is “within the margin” for a recount. “We know, at least based on 2016 and based on existing modeling for how close the margins are in each of these states, Michigan and Pennsylvania, in particular, that they are likely to be within the margin for the recount as well.”
But thin margins aren't the only legal ground for Trump’s challenge. The campaign has also challenged the validity of ballots received and counted after Election Day.
“He is expected to continue to challenge that. In fact, the petition is currently before the Supreme Court to rehear that case. And so there are lots of grounds on which the Trump campaign is expected to be able to challenge the election results,” she said.
According to Hawkins, history can provide clues as to how several Supreme Court Justices will rule if they must make a decision on the election, pointing to the Bush v. Gore case in 2000, where the court ruled in Bush’s favor with a 5-4 Republican majority.
“We know that three of the justices on the Court — Chief Justice Roberts, Justice Kavanaugh, and now Justice Amy Coney Barrett, were all part of that ‘Bush v. Gore’ case on behalf of George Bush,” Hawkins pointed out. “We know about their willingness to have the Supreme Court step in, override decisions of the state, and declare the victor of a presidential election in favor of one candidate over the other. And I don't think it's any mystery what candidate that might be.” |
