Judge denies Trump’s attempt to get out
of E. Jean Carroll's defamation lawsuit.

Former President Donald Trump's attempts to
get out of a lawsuit by former columnist
E. Jean Carroll were denied Tuesday, according
to court filings.

Attorney General Merrick Garland agreed to defend Trump
in court because he was president when he allegedly
defamed Carroll by saying that he couldn't have
raped her decades ago because "She's not my type."

Carroll has asked that Trump provide a DNA sample,
saying that she has his DNA on the clothing she wore
when he allegedly raped her.

Last October, former Attorney General Bill Barr was serving
as Trump's lawyer, saying that Trump was acting in his official capacity as president of the United States when he said Carroll wasn't attractive enough to rape.
The federal judge, in that case, rejected it.

The Justice Department then filed a brief claiming that
they had to protect the "institutional interest of the federal government." They then attempted to stay all proceedings
in the case.

That motion was denied today.

'Absurd': Judge slaps down Trump's latest attempt to toss E. Jean Carroll lawsuit.

Former President Donald Trump just got slapped down in court -- again.

Bloomberg reports that Trump's latest attempt to end E. Jean Carroll's defamation lawsuit against him got tossed out by a judge who called the logic behind the former president's challenge "absurd."

Trump's attorneys had tried to argue that the law Carroll was using to sue him, called the New York Adult Survivors Act, was unconstitutional on the grounds that it supposedly denied him due process under the law.

As Bloomberg describes it, the law "temporarily lifts the statute of limitations on sexual-assault claims," which is what allowed Carroll to use it to sue Trump decades after he allegedly raped her in a department store.

However, U.S. District Judge Lewis Kaplan shot down the notion that Trump's fundamental rights were being violated under the law, and he also trashed claims that the state legislature failed to properly identify a specific injustice in its passage of the New York Adult Survivors Act.

"To suggest that the ASA violates the state Due Process Clause because the legislature supposedly did not describe that injustice to the defendant’s entire satisfaction in a particular paragraph of a particular type of legislative document – itself a dubious premise – is absurd,” wrote Kaplan.

Roberta Kaplan, the attorney representing Carroll, expressed satisfaction with the judge's ruling.

“We are pleased though not surprised that Judge Kaplan denied Donald Trump’s motion to dismiss and upheld the constitutionality of New York’s Adult Survivors Act,” she said. “We look forward to trial in April.”

Trump attorney rushed to correct him after he made major blunder during Carroll deposition.

New excerpts of former President Donald Trump's deposition in the lawsuit filed by E. Jean Carroll against him were unsealed on Wednesday, and they show Trump made an unforced blunder that could a key claim of his defense.

Throughout the case, Trump has maintained that Carroll, who has accused Trump of raping her in the 1990s, was not his "type,"  -
with the implication being that he would never sexually assault someone to whom he was not physically attracted.

Trump during his deposition was shown a photo of Carroll -
and he misidentified her as his former wife, Marla Maples.

"That’s Marla, yeah," Trump said. "That’s my wife."

The Post notes that Trump's attorney, Alina Habba, quickly jumped in to inform him that he was looking
at a photo of Carroll, not of his second wife.

Other excerpts from the deposition transcript show Trump had no inhibitions about lobbing personal insults and making threats against Carroll and her attorneys.

"I will sue her after this is over, and that's the thing I really look forward to doing," Trump told one of the lawyers during the deposition. "And I'll sue you too because this is -- how many cases do you have? Many, many cases, and I know the statements that were made -- that you made. 'Keep Trump busy because this is the way you defeat him, to keep him busy with litigation.'
So I will be suing you also, but I'll be suing her very strongly as soon as this [is over]."

The former president described Carroll as a "nut job" and said she was "mentally sick."

Judge sets April date for Trump’s rape trial despite pleas for postponement.

A date for former President Donald Trump's trial over the claim that he raped writer E. Jean Carroll has been set despite his attempts to postpone it.

In a Tuesday afternoon ruling, U.S. District Court Judge Lewis A. Kaplan ordered the trial to begin on April 25. Kaplan had initially set the trial for April 10 in a ruling last year.

Earlier in the day, the judge lost his patience as Trump's attorneys sought a six-week delay from the proposed trial date in mid-April.

"Things keep happening in this case involving your client," the judge said. "I would be a fool not to take that into account."

Carroll first sued Trump for defamation in 2019 after he denied raping her in the mid-1990s. Last year, she used New York's newly-passed sexual assault law giving survivors a one-time chance to sue beyond the statute of limitations.

Have you ever wondered why court cases never go backwards? They go forward, sometimes they slow down, and sometimes come to a complete stop. But they never go backwards... for some reason that supposedly nobody knows...

Is it a conspiracy? Some sleight of hand? Bribes and payoffs? Something so sinister you'd go hide in a cave if you found out...?

There would be no case/trial-
If
trump gave a DNA sample to prove he is inocent..
He is still fighting, to the death, not give a sample..
All the $$$$ on lawyers- and to stop it-
give a DNA sample and have done with it.

He should be able to get a sample from a skid mark in his draws

Temple has been so distraught for a while over this case .. When he starts new threads with it you know he really means it... I think i remember Obi having to throw some of it in the Temple Trash heap cuz he kept pasting that same thing about Trump's sperm for DNA ...
