FBI confirms there was no insurrection on Jan. 6 by Conn Carroll, Commentary Editor August 20, 2021 12:16 PM
The Cambridge Dictionary defines “insurrection” as: “an organized attempt by a group of people to defeat their government and take control of their country, usually by violence”
By that definition, there was no “insurrection” at the United States Capitol on Jan. 6, according to the FBI. Reuters reports:
The FBI has found scant evidence that the Jan. 6 attack on the U.S. Capitol was the result of an organized plot to overturn the presidential election result, according to four current and former law enforcement officials.
"Ninety to ninety-five percent of these are one-off cases," said a former senior law enforcement official with knowledge of the investigation. "Then you have five percent, maybe, of these militia groups that were more closely organized. But there was no grand scheme with Roger Stone and Alex Jones and all of these people to storm the Capitol and take hostages." This report is a devastating blow to President Joe Biden and Democrats, who have attempted to make the existence of an “insurrection” on Jan. 6 a key issue in the 2022 midterm elections. Reuters does note that some “cells of protesters,” including members of the Oath Keepers and Proud Boys, did coordinate to “break into the Capitol,” but the FBI found “no evidence that the groups had serious plans about what to do if they made it inside.”
None of this excuses the violent riot that happened on Jan. 6. The FBI has arrested 570 rioters and each and every one of them should be prosecuted to the full extent of the law.
But that is what the event was: a riot, just like so many other riots. Trying to politicize it and turn it into something it wasn't won’t make the Capitol any safer.

| Almost seems like the FBI didn't take the democrat's insurrection TV series very seriously ... So what about the political prisoners that have been held in the DC jail for 2 years with no bail and no trials? No rights to a speedy trial, no presumption of innocence...just held indefinitely.. No word about them |

| Jan. 6 Trial Involving Proud Boys Paused After Attorney Accuses FBI of Altering Evidence Jon Dougherty, March 13, 2023
A much-watched trial involving Jan. 6 defendants who are members of the Proud Boys organization came to a screeching halt late last week after an attorney for one of the accused leveled the accusation that the FBI had altered evidence in the case.
Dominic Pezzola, one of the defendants in the Jan. 6, 2021, Capitol breach trial, had the proceedings paused on Thursday after defense attorneys presented classified FBI messages in court. The defense attorneys claimed that the messages showed FBI agents discussing the alteration of evidence, The Epoch Times reported.
Pezzola is currently on trial for obstruction and conspiracy charges related to his involvement in the Jan. 6 Capitol breach. He was arrested on Jan. 15, 2021, and indicted the same month. The trial began in January of this year.
“There are a couple of emails between FBI agents casually discussing altering a document and destroying hundreds of pieces of evidence. It’s very disturbing and right now we have more questions than answers,” Roger Roots, an attorney at John Pierce Law who represents Pezzola, told the outlet in an email.
Roots confirmed that the trial was paused by U.S. District Court Judge Timothy J. Kelly, who was appointed by former President Trump, in Washington after leaked messages from the FBI were revealed in court.
Roots was referring to an exchange that came to light on Wednesday during the testimony of FBI special agent Nicole Miller, who was involved in the agency’s investigations of the Jan. 6 defendants, the outlet said.
During the cross-examination of Miller by Nick Smith, attorney for Proud Boys member Ethan Nordean, classified FBI emails were revealed that were hidden in a tab in an Excel spreadsheet and were used as evidence in Pezzola’s case by his defense attorney to support a motion to dismiss the charges against Pezzola.
In the motion, Pezzola’s legal team argued that the emails revealed that the FBI monitored the communications between Nordean and his lawyer, which violates the Sixth Amendment that prohibits interference with the right to counsel, The Epoch Times continued.
“In the Nordean case, confidential attorneys-client trial/defense strategy and position was wrongfully obtained by the government, about which was overheard, shared, utilized, where potentially ‘338 items of evidence’ were ordered to be ‘destroyed,’” Pezzola’s legal team noted in its motion to dismiss.
A separate filing by Nordean’s lawyers said that Miller noted in one correspondence that “[her] boss assigned [her] 338 items of evidence [she has] to destroy.” Nordean’s lawyers further alleged that another email showed an agent requesting Miller to “go into [a] CHS [informant] report” that Miller “just put [together] and edit out that [the agent] was present.”
Pezzola’s lawyers also claimed in their motion that the emails reveal that Miller had “admitted fabricating evidence and following orders to destroy hundreds of items of evidence.” They also alleged that the government had gained information that was beneficial to their case, resulting in substantial prejudice to all the defendants, including Pezzola, The Epoch Times noted.
“If justice means anything, it requires this case to be dismissed,” Pezzola’s lawyer said.
“My thoughts are we need a longer pause to get to the bottom of some of Agent Miller’s emails,” Roots told the outlet.
Pezzola’s legal team also asserted in their motion to dismiss that recently discovered footage of the Jan. 6 Capitol breach is exculpatory evidence, which the government failed to disclose, thus violating their client’s constitutional rights as defined in Brady v. Maryland. In the 1963 case, the Supreme Court ruled that prosecutors must provide exculpatory evidence to the defense counsel.
The motion came just two days after House Speaker Kevin McCarthy (R-Calif.) released over 40,000 hours of footage from Jan. 6 to Fox News’s Tucker Carlson, who subsequently aired some of the footage on his show on Monday and Tuesday.
One of the tapes aired showed Capitol Police officers walking alongside Jacob Chansley, who is currently serving a 41-month sentence after pleading guilty to an obstruction charge related to the Jan. 6 breach. In the video, Chansley was unarmed and walked past several Capitol police officers. |

| J6 Trial Reveals FBI Had ‘Complex Web’ of at Least 20 Extremist Group Informants in Run-Up to Capitol Riot
By Kyle Becker, March 25, 2023 Attorneys at the Department of Justice (DOJ) would not tell a J6 defendant’s attorney if planned witnesses in the case were FBI informants. The prosecution’s refusal to disclose the critical information came after the government revealed that a planned witness had been an informant. The revelations come via a court transcript obtained by American Greatness’ Julie Kelly. The defendants in the case are former Proud Boys National Chairman Enrique Tarrio and members Ethan Nordean, Joseph Biggs, Zachary Rehl and Dominic Pezzola. The defendants are accused of allegedly participating in a seditious conspiracy plot to overthrow the U.S. government. The DOJ said Wednesday that a defense witness for Enrique Tarrio, himself a prior FBI informant, had been a confidential human source (CHS) for the bureau from April 2021 to January 2023. Tarrio’s attorney, Sabino Jauregui, said at the Thursday hearing that he asked the DOJ if his next two witnesses were FBI sources as well, Kelly noted. “You know what they told me?” Jauregui said. “Nothing. They don’t know.” The New York Times has identified the female source as Jen Loh, a former member of “Latinos for Trump.” Loh, the FBI confidential source, reportedly had 20 to 30 communications with Biggs, his attorney, Norman Pattis, said at the Thursday hearing. Loh said in a Friday interview that she provided “useful information” about leftist protestors to the FBI, and then informed the bureau about “any type of domestic terrorism — on the right or the left,” the NYT reported. FBI San Antonio Special Agent Kristina Spindel swore in a Thursday statement Loh had given the FBI information as far back as fall 2019. Pattis told presiding Judge Timothy Kelly the defense was “very close to a stipulation on as many as eight or nine other” FBI sources. “There was a complex network of confidential human sources at the government’s disposal,” Pattis said. “My biggest concern is the fact that we still have confidential human sources who are unknown to us, ” Rehl’s lawyer, Carmen Hernandez, said. But Judge Kelly shot down a defense subpoena Tuesday for Proud Boys member Kenneth Lizardo. Kelly ruled that Lizardo had “a reporting relationship with the FBI” and had declared his intention to plead the Fifth if called to testify. Lizardo was an associate of Tarrio who went with him to a Jan. 5, 2021 meeting in Washington, D.C., with Oath Keepers militia group founder Stewart Rhodes. Rhodes was ultimately convicted on charges of participating in Jan. 6-related seditious conspiracy in November 2022. According to the NYT, the FBI had up to eight informants within the Proud Boys group in the months surrounding the Jan. 6 Capitol riot. That includes a period of time both before and after the event. Former Tennessee Proud Boys chapter leader Matthew Walter told the Times in February that around 20 other group members besides himself had FBI relationships around that time. |

| Law Enforcement Had “At Least 40” Undercover Informants On January 6th
By Chris, April 6, 2023 On Wednesday, Roger Roots, the lawyer for defendant Dominic Pezzola, revealed that there were at least 40 undercover informants working as part of law enforcement agencies to conduct surveillance among defendants on January 6th. Pezzola, an American Proud Boys member, is in jail and faces charges including seditious conspiracy for his involvement in the Capitol riot on January 6th. On Thursday, Pezzola’s defense filed a motion to reveal all undercover informants related to the January 6 case. The filed document said that there were multiple undercover law enforcement officers present during the January 6th attack on the U.S. Capitol, with at least 40 undercover informants or agents conducting surveillance among the defendants. Roots said, “Some of these undercover Metro officers marched with the Proud Boy march, and some appear to have played roles of instigators, in that they are seen on body-worn videos chanting ‘Go! Go!,’ ‘Stop the Steal!,’ and ‘Whose house? Our house!’ on Jan. 6. Others generally followed demonstrators toward the Capitol.” The FBI has acknowledged the presence of eight confidential human sources (CHSs) among the Proud Boys, but it is now known that at least two other agencies had more undercover agents, informants, and CHSs than the FBI. The Metropolitan Police Department (MPD) had at least 13 plainclothes agents, while Homeland Security Investigations (HSI) had 19 CHSs. Some of the undercover officers belonging to the MPD are seen on video and in private texts instigating the crowd to storm the Capitol. The scope and scale of the undercover government operations on January 6th could have impacted the defense strategies if defense counsel had known about it earlier. The government is accused of withholding exculpatory information, and defense lawyers argue that the newly disclosed information supports the Proud Boys’ assessment of antifa prior to January 6th. The defense claims they are entitled to know every Homeland Security Investigations CHS operating among Proud Boys and Capitol protestors on Jan. 6th. |

| BREAKING: Biden White House Directly Coordinated With FBI to Set Up Trump Raid According to New Docs
By Kyle Becker, April 10, 2023 There are new revelations coming to light about the Federal Bureau of Investigation’s unprecedented raid against former President Donald Trump prior to the 2022 midterm elections. As reported by America First Legal, a judicial watchdog, “records obtained from our investigation into the circumstances surrounding the Mar-a-Lago raid further confirm that the FBI obtained access to these records through a ‘special access request’ from the Biden White House on behalf of the DOJ.” The details, themselves, are shocking, as AFL noted in its press release: On August 8, 2022, the Federal Bureau of Investigation (FBI) conducted an unprecedented raid of Mar-a-Lago on the ground that potentially classified records existed there. According to press reports, Biden Administration aides were “stunned” to hear of this development. However, new NARA records obtained through America First Legal’s investigation into the circumstances surrounding the Mar-a-Lago raid further confirmed that the FBI obtained access to these records through a “special access request” from the Biden White House on behalf of the Department of Justice (DOJ). It appears that the Biden White House and DOJ coordinated to obtain the Trump records and perhaps create a pretext for the law enforcement raid by way of a “special access request.” Furthermore, the revelations mean that the National Archives misled Congress in its role in the FBI raid, which is tantamount to election interference. This stunning revelation suggests that NARA was misleading Congress about the White House’s role in the shocking raid of President Trump’s home, and the fact that the Biden White House was acting “on behalf of” the DOJ raises significant legal concerns. The special access statute authorizes special access requests to an incumbent president only when the records in question are needed for “the conduct of current business” of the White House. Providing documents to the DOJ for purposes of a criminal investigation is not the “current business” of the White House. Accordingly, America First Legal is demanding NARA turn over records related to the Biden White House’s involvement in the politically motivated raid of President Trump’s home. “The evidence suggests that the ostensibly nonpartisan National Archives and Records Administration misled Congress about the Biden White House’s responsibility for the FBI’s raid of former President Trump’s home,” said Reed D. Rubinstein, Senior Counselor and Director of Oversight and Investigations. “The evidence further suggests that Biden officials in the Executive Office of the President and the Department of Justice unlawfully abused their power and then lied about it to the American people. This government, it seems, acknowledges no limits on its power to harass, intimidate, and silence its political opponents.” Read the FOIA here. https://aflegal.org/wp-content/uploads/2023/04/2023.04.10-AFL-NARA-OIG-FOIA-re-FBI-MAL-Docs.pdf |
